ATM Support Services Terms & Conditions

This Terms & Conditions Agreement ("Agreement") governs your use of the ATM support services provided by Quality Data Systems ("Company"). By using our services, you ("User") agree to be bound by the terms and conditions outlined below.

These terms & conditions govern User’s use of Company’s support services only in the absence of a separate Master Services Agreement (MSA) between User and Company. If a Master Service Agreement (MSA) is in place, the terms of that agreement will supersede and govern the User relationship with the Company.

Services Provided:

The Company provides support services for Automated Teller Machines ("ATMs"), including but not limited to:

  • Technical troubleshooting and repair.

  • Software updates and maintenance.

  • Network connectivity support.

  • Remote diagnostics and support.

The scope of services will be as defined in the applicable service agreement or work order.

User Responsibilities:

  • The User shall provide accurate and complete information regarding the ATM and any related issues.
  • The User shall cooperate with Company personnel during service provision.
  • The User shall ensure a safe and accessible environment for Company personnel to perform services.
  • The User is responsible for maintaining the security of their ATM location and reporting any suspicious activity.
  • The User is responsible for providing adequate power and network connectivity to the ATM.

Company Responsibilities:

  • The Company shall provide services in a professional and timely manner.
  • The Company shall adhere to industry’s best practices and standards.
  • The Company shall maintain confidentiality of User information.
  • The Company will provide reasonably trained personal to service the ATM.

Payment and Fees:

  • Fees for services will be as outlined in the applicable service agreement or work order.
  • Payment terms will be as specified in the invoice.
  • Late payments may incur penalties as specified by the company.

Limitation of Liability:

  • The Company shall not be liable for any indirect, incidental, or consequential damage arising from the use of our services.  
  • The Company's liability shall be limited to the amount paid by the User for the services provided.
  • The Company is not responsible for losses due to vandalism, robbery, or other criminal activity.

Confidentiality:

  • Both parties agree to maintain the confidentiality of any proprietary or sensitive information shared during the course of service provision.  

Termination:

  • This Agreement may be terminated by either party upon written notice, as specified in the service agreement.
  • The company may terminate service immediately in the case of non-payment.
  • The company may terminate services immediately if the user is found to be engaged in illegal activities.

Governing Law:

  • This Agreement shall be governed by and construed in accordance with the laws of Charlotte, North Carolina.

Entire Agreement:

  • This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements or understandings.  

Amendments:

  • This agreement may be amended by the Company at any time, and those changes will be posted to the Company’s website. Continued use of the Company’s services constitutes acceptance of those changes.

By using our services, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions of this Agreement.
